Terms of Service
These terms govern your use of CartAbandon, the abandoned cart recovery service at cartabandon.com. The service is provided by the administrator of the cartabandon.com service. By creating an account or buying a plan you accept these terms. Questions go to support@cartabandon.com. Last updated 14 October 2026.
Words used in these terms
- "Service" means CartAbandon, including the website, the panel, the storefront script, the API and the messages sent through it.
- "We" or "us" means the administrator of the cartabandon.com service.
- "You" or "merchant" means the business that creates an account and uses the service for its online store or stores.
- "Shopper" means a visitor or customer of your store.
- "Shopper data" means personal data about shoppers that your store sends to the service.
- "Plan" means the subscription you choose: Starter, Growth, Scale or Plus.
Your account and who may use it
You must be a business, or a person acting for a business, to use the service. You must give correct information when you sign up and keep it up to date. You are responsible for everything done under your account, including by teammates you invite. Keep your password safe and tell us at support@cartabandon.com if you think someone used your account without permission.
You confirm your email with a one-time code. One subscription is attached to each account. To run more stores, choose a plan with a higher store limit.
What you get before you pay
There is no free plan. Before you pay, you can get one free revenue estimate for your store and, after you create an account, one AI-written sample message. Connecting a store and running recovery flows requires a paid plan.
Subscriptions renew automatically until you cancel
- Plans are billed monthly or yearly. Yearly billing costs 50 percent less than monthly.
- Your subscription renews automatically at the end of each period at the price then in effect for your plan, until you cancel.
- Prices are in USD. Taxes such as VAT or sales tax may be added at checkout based on your location.
- Payments are taken by card through our payment operator. Pay by invoice is available on annual Plus plans.
- You get an invoice for every payment in the panel.
- If a payment fails, we may retry it and ask you to update your card. If it still fails, we may pause the service until the balance is paid.
If we change plan prices, we tell you by email at least 30 days before the new price applies to your next renewal.
Plan limits count usage in each billing period
Each plan has limits on recovered-cart attempts, SMS, WhatsApp messages, AI-written messages, stores and seats, as shown on the pricing page. A recovered-cart attempt is one cart, checkout or payment that enters a recovery flow.
- Limits count usage within the billing period and reset when a new period starts.
- Deleting flows, contacts or messages does not free quota.
- At 80 percent use we show a prompt to upgrade.
- At 100 percent, new recovery attempts pause. Sequences already running finish as planned.
- We never charge per message or take a percent of recovered revenue.
Upgrades are charged right away, downgrades wait for the next period
When you upgrade, we charge the price difference for the rest of the current period immediately. The new plan and its limits apply once that payment succeeds. If the payment fails, you stay on your current plan.
When you downgrade, the change takes effect at the start of your next billing period. There is no refund to your card for the difference.
You can cancel at any time in the panel
You can cancel in the panel at any time. Your plan keeps running until the end of the period you paid for and then stops renewing. We do not refund partial periods, except where the law requires it.
You send marketing only to people who agreed to get it
The service sends messages on your behalf, so you must use it lawfully. You agree that:
- You send marketing email, SMS and WhatsApp messages only to shoppers who gave valid consent for that channel, where the law requires consent.
- You are responsible for your lawful basis, for collecting and recording consent, for the content of your offers, and for following privacy and marketing laws that apply to you, including GDPR, TCPA, CAN-SPAM and CASL.
- You do not upload purchased, rented or scraped contact lists.
- You do not send spam, misleading messages or messages that hide who you are.
- You do not use the service to sell goods or services that are illegal or banned by our providers, such as weapons, illegal drugs or counterfeit goods.
- You do not try to break, overload, copy or reverse engineer the service, or get around plan limits.
- You keep the unsubscribe link, the STOP keyword and the WhatsApp opt-out working.
The service helps you comply: it stores consent source and timestamp per contact and channel, adds one-click unsubscribe to every email, respects quiet hours by time zone and keeps payment-failure notices separate from marketing. These tools do not replace your own legal duties.
You own your store data and we process it for you
You own your store data, including shopper data. You give us the right to use it only to provide the service to you. For shopper data we act as your processor under the Data Processing Agreement, which applies automatically with your subscription and can be downloaded signed in the panel. How we handle merchant account data is described in our Privacy Policy.
You can export your data from the panel while your account is active. After you close the account, we delete your shopper data within 30 days.
You stay in control of AI-written messages
The service drafts messages in your brand voice with AI and picks channel, timing and offer within the rules you set. You control the result through your settings: brand voice, maximum discount, minimum margin, no-discount lists, quiet hours and frequency caps. Every decision is logged with a plain-English reason. You are responsible for checking that your messages and offers are accurate and lawful. AI output can contain mistakes, so review templates before you turn a flow on.
We aim for a reliable service, with an SLA on Plus
We work to keep the service available at all times, but we do not promise it will never be interrupted, for example during maintenance or outages at our providers. An uptime SLA of 99.9 percent applies only to the Plus plan, with the remedies described in the panel for that plan. We may improve and change features as long as the core of your plan stays in place.
We may suspend accounts that break these terms
We may suspend or limit your account, with notice where possible, if you break these terms, if you send messages without consent, if your use creates a security or legal risk, or if payment is overdue. We restore the account once the problem is fixed. We may close an account for serious or repeated abuse.
Our liability is limited to what you paid us
The service is provided as it is offered on the pricing page and in the panel. To the extent the law allows:
- We are not liable for indirect or consequential loss, such as lost profit, lost revenue or lost data.
- Our total liability for all claims in any 12 month period is limited to the fees you paid us in the 12 months before the event that caused the claim.
- You are liable for claims that arise from messages you send without a lawful basis or consent, and for the content of your offers.
Nothing in these terms limits liability that cannot be limited by law, such as liability for intent or gross negligence.
The service stays ours, your content stays yours
We own the service, its software and its design. Your subscription gives you a right to use it for your stores while your plan is active. Your brand assets, product data and message content remain yours.
We tell you before these terms change
We may update these terms. For important changes we email account holders at least 30 days before they apply. If you do not agree, you can cancel before the change applies. Using the service after that date means you accept the new terms.
Which law applies
These terms are governed by the law of the European Union member state where the administrator is established, without prejudice to mandatory consumer protection or local law that applies to you. Disputes go to the courts of the administrator's registered seat, unless the law says otherwise.
